Britney Spears has reportedly ended her battle to win back custody of her children, Sean Preston and Jayden James, from ex-husband Kevin Federline.

Kevin’s attorney, Mark Vincent Kaplan, says both Britney and Kevin reached and signed off on a settlement in their custody case today.

Kaplan told OK!, “At about 8 p.m. PT, a final settlement in the Kevin Federline-Britney Spears custody case was signed. All parties have agreed to the following: Kevin will retain sole legal and physical custody of Sean Preston and Jayden James. Britney will continue to have visitation rights which may increase over time. The agreement will be presented to the court in the morning for approval by the commissioner.”

Britney Spears is expected to attend her custody status hearing in a Los Angeles downtown courthouse with her parents today.

Britney, 26, has been under the conservatorship of her father since her one-week-early release from UCLA Medical Center back in February.

Her ex-husband, Kevin Federline will also attend, said his spokesman, Elliot Mintz

Kevin has had full custody of both, two-year-old Sean Preston and one-year-old Jayden James since January.

Tuesday’s hearing will include discussion of a psychiatrist’s evaluation of Britney.

Britney has recently been on the CBS comedy How I Met Your Mother.

Cameron Federline, K-Fed’s younger brother, welcomed a baby girl about a week ago.

“Kevin is really excited to be an uncle,” a source tells Us Weekly.

Cameron, 23, was arrested last year for “illegal possession of alcohol by a minor” and “illegal possession of alcohol by a minor by consumption.”

Britney Spears reportedly attended Cameron’s high school graduation in his hometown of Pendleton, Oregon, while married to K-Fed.

Britney Spears’ sons — Sean Preston, 2, and Jayden James, 17 months — haven’t seen their mom in over a month. The last time they saw her was the night of January 3, when she was admitted to the Cedars-Sinai Medical Center psych ward.

“They have not been asking about Britney,” a Federline source tells Us Weekly.

But Britney hasn’t lost focus!

“She desperately wants the kids,” a family source says. “She cries about it. She hasn’t put the children’s belongings away,” an insider said. “Her home has pictures of her kids everywhere. She loves them very much.”

Adds a family source, “There’s been a real change in how she is because she has been smothered in love. To suddenly know after all this time that she has support has been incredible for her. She knows that something is wrong with her. She knows that something can’t quite be right because of the sheer fact she’s separated from her kids.”

Just weeks before her hospital visit, Britney Spears took part in a photoshoot with Sean Preston, 2, and Jayden James, 1.

“She was very loving,” OK! photographer Dani Brubaker says. “She told me she loved her children and that they are her life. I’m told that when she saw the photographs she literally cried for over an hour and stared at them all night long.”

A friend added, “The only reason she’s doing this is because she wants [her sons] to look up to her onstage and be like, ‘That’s my mama,’ and be proud of her. She’d put her life before them and die for Jayden and Preston. They’re her whole world. Britney has always said, ‘I would die for my boys if that’s what it took to prove I loved them. I’d do anything for them.’ ”

People is also reporting that Dr. Phil violated the trust of Britney’s family by making public statements about his hospital visit with Brit Brit and his call for her to receive therapy.

Details magazine dropped their Power 50 list in their latest issue with everyone under age 45.

Taking the top spot were “Disney kids” including Zac Efron, Shia LaBoeuf, Miley Cyrus, Hilary Duff, Britney Spears and other Mouseketeers.

Kevin Federline, labeled “Good Father” alongside Larry Birkhead, only ranked No. 7 but took the cover of their Power issue, which hits newsstands on Dec. 4.

On fatherhood: “To be a father is…everything. It shows me how little I am.”

On the direction of his career: “I’d actually like to play somebody other than a bad guy or an ass.”

On what is playing on his TV right now: “My TVs are pretty much G-rated right now. Anything from SpongeBob to Finding Nemo, and you know, I’m still trying to decide which one I like more.”

Kevin Federline claims Britney Spears was abusive during their relationship, reports Life & Style.

“Kevin says she hit him several times during their marriage,” says an insider of the latest allegation from Mr. Spears.

In the custody case, the judge ordered Britney not to use corporal punishment on the boys. “Kevin asked for that,” says the insider, “because he’s scared she’ll hit the kids, too.”

A Brit insider refutes Kevin’s claims, however, saying, “This is just another attempt to make Britney look like a bad mom.”
